§ 1

Definicje

For the purposes of these Rules of Procedure, the following terms shall have the following meanings:

  1. Buyer - a natural person, a legal person or a handicapped legal person,
  2. Consumer - a natural person concluding a sales contract with the Seller not related directly to his business or professional activity,
  3. The Regulations - these Regulations, available at http://www.loveyourself.pl/strona/regulamin
  4. Shop - online shop belonging to the Company Name, Company ADDRESS, NIP: , REGON:

§ 2

Postanowienia wstępne

  1. Through the Store, the Seller conducts retail sales and at the same time provides electronic services to Buyers. Through the Store, the Buyer may purchase products shown on the Store's website.
  2. Regulations define the rules and conditions of using the Store, as well as the rights and obligations of the Seller and the Buyers.
  3. In order to use the Store, including in particular to make a purchase in the Store, it is not necessary to meet specific technical conditions by a computer or other device of the Buyer.                                                            It is sufficient:                                                                                           a. access to the Internet,
    b. a standard operating system,
    c. a standard web browser,
    d. have an active e-mail address.
  4. The Buyer may not make a purchase in the Shop anonymously or under a pseudonym.
  5. it is forbidden to provide illegal content while using the Store, in particular by sending such content via forms available in the Store.
  6. All prices of products listed on the pages of the Store are gross prices.

§ 3

Usługi świadczone drogą elektroniczną

  1. Through the Store, the Seller provides services to the Buyer by electronic means.
  2. The basic service provided electronically to the Buyer by the Seller is to enable the Buyer to place an order in the Store. Placing an order is possible without the need to create an account in the Shop.
  3. If the Buyer decides to set up an account in the Store, the Seller shall also provide the Buyer with an electronic service consisting in setting up and maintaining an account in the Store. The account stores the Buyer's data and the history of orders placed by the Buyer in the Store. The Buyer logs in to the Account using his e-mail address and a password defined by him.
  4. Creating an account in the Shop is done by filling in and sending, using the automatic mechanism of the Shop, a registration form. Once the registration form is sent, an agreement for maintaining an account in the Store is concluded between the Buyer and the Seller. The agreement is concluded for an indefinite period of time, and the Buyer may terminate the agreement with immediate effect at any time, deleting the account.
  5. Services are provided electronically to the Buyer free of charge. The following contracts of sale concluded through the Store are payable
  6. In order to ensure the Buyer's security and data transmission in connection with the use of the Store, the Seller shall take technical and organizational measures appropriate to the degree of security risk to the services provided, in particular measures to prevent the acquisition and modification of personal data by unauthorized persons.
  7. The Seller shall take steps to ensure the proper functioning of the Store. The Buyer should inform the Seller of any irregularities or interruptions in the functioning of the Store.
  8. Any complaints related to the functioning of the Store, the Buyer may report via e-mail to the following e-mail address:. In the complaint, the Buyer should provide his name and surname, correspondence address, as well as the type and date of occurrence of irregularities related to the functioning of the Store. The Seller shall consider all complaints within 14 days of receipt of the complaint and shall inform the Customer about its resolution to the e-mail address of the complainant.

§ 4

Składanie zamówienia

  1. The Buyer may place an order as a registered customer or as a guest.
  2. The registered customer is the Buyer who has an account in the Shop. Buyer can create an account from the tab "Login / Registration" or when placing an order.
  3. In order to place an order, the Buyer is obliged to take the following steps:
    a. select the product or products to be ordered by clicking the "Add to    cart" button,
    b. click on the "Go to checkout" button in the basket view,
    c. log in to your account in the Shop, create an account or choose the option "Buy as a guest" - this does not apply to the Buyer who logged in to his account before starting to place an order,
    d. provide the address for sending the order and data to the invoice - if the Buyer has previously added certain data to the account, may select these data without the need to resupply them or provide other data,
    e. choose the delivery and payment method for your order,
    f. provide any comments to the contract in the "Notes to the contract" field
    g. read and accept the Regulations - the Buyer accepts the Regulations only if he has read them and actually accepts their provisions; acceptance of the Regulations is voluntary but necessary to place an order,
    h. click on the "Buy and Pay" button.
  4. If the Buyer has chosen a payment method for the order in the form of payment via PayPal or Przelewy 24, after clicking on the button "Buy and Pay" the Buyer will be transferred to the transaction page of PayPal or Przelewy 24 in order to pay for the order. After the payment is made, the Buyer will be redirected back to the Shop's website with the confirmation of placing an order. At this point in time, the contract of sale of the products covered by the order shall be deemed concluded between the Buyer and the Seller.
  5. If the Buyer has chosen a payment method for an order other than PayPal or Przelewy 24, after clicking on the "Buy and Pay" button, the Buyer will be immediately transferred to the order confirmation page. At this point in time, the contract of sale of the products covered by the order is deemed to be concluded between the Buyer and the Seller.
  6. The Buyer must provide true personal information in the order form. The Buyer is responsible for providing false personal data. The Seller reserves the right to suspend the implementation of the order if the Buyer provided false data or if these data raise reasonable doubts of the Seller as to their correctness. In such a case, the Buyer shall be informed by phone or e-mail about the Seller's doubts. In such a situation, the Buyer shall have the right to explain any circumstances related to the verification of the accuracy of the given data. In the absence of data allowing the Seller to make contact with the Buyer, the Seller shall provide all explanations after the Buyer makes contact.
  7. The Buyer declares that all data provided by him in the order form are true, but the Seller is not obliged to verify their truthfulness and correctness, although he has such a right in accordance with paragraph 6 above.

§ 5

Formy dostawy i metody płatności

  1. The Buyer may choose the following forms of order delivery:                a. delivery in Poland via GLS courier company - 1) payment by bank transfer - 17 zł, 2) cash on delivery - 20 zł, approximate delivery time: 8 working days from the moment of order realization,                                   b. delivery outside the country via the Polish Post Office - the cost is selected individually depending on the country of destination.
  2. The cost of delivery is borne by the Buyer, unless otherwise specified by the Seller in the Store. Personal pickup does not involve any additional delivery costs for the Buyer.
  3. The Buyer has the choice of the following payment methods for the ordered products:                                                                                     a. transfer to the bank account of the Seller,                                               b. payment via PayPal or Przelewy24.

§ 6

Realizacja zamówienia

  1. After the Buyer places an order in accordance with the procedure described in § 4 of the Regulations, a confirmation of the order will be sent to the Buyer's e-mail address.
  2. If the Buyer has chosen the payment method by bank transfer to the bank account of the Seller, he is obliged to pay for the order within 2 days of the conclusion of the contract.
  3. The execution of the order consists in its preparation for shipment to the Buyer. The order shall be deemed completed at the moment of preparing the order for dispatch or preparation for personal collection by the Buyer.
  4. The time of realization of the order each time is indicated in the product description.
  5. If the order covers more than one product, the order completion time shall be the longest time indicated in the description of the product included in the order.
  6. Order processing time shall be counted from the moment of making payment for the order, unless the Buyer chose the method of payment on delivery - then order processing time shall be counted up to the moment of concluding the contract.
  7. After completing the order, the Seller shall send to the e-mail address of the Buyer a confirmation of order completion and start sending the order to the Buyer.
  8. The order shall be sent to the Buyer in the manner chosen by the Buyer in accordance with § 4.1 of the Regulations.
  9. The time of order delivery to the Buyer depends on the shipping method chosen by the Buyer and is counted from the date of order completion in accordance with § 6 paragraph 3 of the Regulations.

§ 7

Odstąpienie od umowy Konsumenta

  1. The consumer who concluded a remote agreement with the Seller, has the right to withdraw from the agreement without giving any reason within 14 days from the date of taking possession of the purchased goods.
  2. The right of withdrawal shall not apply to a contract where the subject matter of the service is an unprocessed item, manufactured to the consumer's specifications or intended to meet his individual needs.
  3. In order to withdraw from the contract, the Consumer must inform the Seller of his decision to withdraw from the contract by means of an unambiguous statement - by e-mail.
  4. In order for the complaint to be accepted, it is necessary to write to us at contact@loveyourself.pl or use the contact form. The following should be written in the message:                                                              a. what product(s) are you going to send to us?                                           b. do you want a refund for a product or a replacement product? Optionally, specify the reason for the refund.                                             c. show proof of purchase.                                                                        d. if applicable, describe the product defect, optionally include pictures of the product defect.
  5. In order to keep the period for withdrawal from the contract, it is sufficient for the consumer to send information concerning the exercise of the right of withdrawal before the expiry of the period for withdrawal.
  6. Consumer is obliged to return the product to the Seller no later than 14 days from the date on which he withdrew from the contract. To meet the deadline it is sufficient to send back the product before its expiry.
  7. The consumer bears direct costs of returning the goods.
  8. In case of withdrawal from the contract, the Seller shall return to the Consumer all payments received from the Consumer, except for the costs of delivery of products, no later than 14 days from the date on which the Seller was informed about the exercise of the right of withdrawal. The refund shall be made using the same methods of payment as those used by the consumer in the original transaction, unless the consumer has expressly agreed otherwise. In any event, the consumer shall not incur any fees as a result of the form of refund.
  9. If the seller has not offered to collect the goods himself from the consumer, he may refrain from returning payments received from the consumer until he has received the goods back or until the consumer has provided evidence of having sent back the goods, whichever is the earlier.
  10. The consumer shall be liable for any diminished value of the product resulting from the use of the product beyond what is necessary to establish the nature, characteristics and functioning of the product.

§ 8

Odpowiedzialność za wady

  1. The Seller is obliged to deliver to the Buyer a product free from defects.
  2. The Seller is liable to the Buyer if the product sold has a physical or legal defect (warranty for defects).
  3. If the product sold has a defect, the Buyer may:                                           a. demand replacement of the product with a product free from defects,                                                                                                       b. demand that the defect be rectified,                                                     c. make a declaration of price reduction,                                                   d. make a declaration of withdrawal from the contract.
  4. If the Buyer finds a defect in the product, he should inform the Seller about it, specifying at the same time his claim related to the defect or making a statement of the relevant content.
  5. The Buyer may use the contact form. The message should be written:      a. what product(s) are you going to send us?                                              b. you want a refund for a product or maybe a replacement product. Optionally, you can specify the reason for the refund.                                     c. show proof of purchase.                                                                        d. describe the product defect, optionally include pictures of the product defect.
  6. The Buyer may contact the Seller by either mail or e-mail.
  7. The Seller will respond to the complaint made by the Buyer within 14 days from the date of delivery of the complaint to him using such means of communication, using which the complaint was made.
  8. Details concerning the Seller's warranty for defects are regulated by the provisions of the Civil Code (Articles 556 - 576).

§ 10

Sposoby rozpatrywania reklamacji i dochodzenia roszczeń

  1. The Seller agrees to submit any disputes arising in connection with the sale of goods by way of mediation proceedings. Details shall be determined by the parties to the conflict.
  2. The consumer has the opportunity to use out-of-court methods of examining complaints and pursuing claims. Among other things, the Consumer has the possibility:                                                                     a. apply to a permanent amicable consumer court to resolve a dispute arising out of a concluded sales contract,                                                          b. request the Provincial Inspector of the Trade Inspection to initiate mediation proceedings for amicable settlement of the dispute between the Buyer and the Seller,                                                                             c. take advantage of the assistance of a poviat (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection.

  4. The consumer can also use the ODR platform, which is available at http://ec.europa.eu/consumers/odr. The platform is used to resolve disputes between consumers and traders seeking out-of-court settlement of a dispute concerning contractual obligations arising under an online sales or service contract.

§ 11

Postanowienia końcowe

  1. The Seller reserves the right to introduce and cancel offers, promotions and to change prices of products in the Store without prejudice to the rights acquired by the Buyer, including in particular the terms and conditions of contracts concluded before the change.
  2. The Seller reserves the right to introduce changes to the Regulations. Contracts concluded before the amendment of the Regulations shall be governed by the Regulations in force on the date of the conclusion of the contract.
  3. Buyers who have an account in the Shop will be notified of any change in the Regulations by e-mail to the e-mail address assigned to the account. If the Buyer does not accept the content of the new Regulations, he has the right to terminate the account agreement at any time by deleting the account or submitting to the Seller an appropriate statement, in any form, about the termination of the account agreement.
  4. These Regulations shall be effective as of x.x.2019.
